HEALTH LAW

   Health care is one of the most regulated industries in the U.S., and our health law attorneys routinely assist clients with the complex issues that arise from the maze of laws, rules, and public policy imposed on health care providers by the government

Familiar with key personnel in state and federal regulatory agencies, our attorneys are familiar with state executive office leadership and regularly represent clients before state agencies.

Collectively, we have extensive backgrounds regarding hospitals, long-term care, physician practices, licensed professional practitioners, laboratory and diagnostic services, durable medical equipment, rural health care providers, and various ancillary services.

   When disagreements become legal disputes, we work to represent clients in commercial contract, health care fraud, antitrust, employment, and medical negligence lawsuits. We use our regulatory expertise to develop the strongest defense possible by identifying and deciphering the regulations and strategies necessary to effectively represent our clients.

• Administrative and Regulatory Compliance - represent health care industry clients in licensure acquisition, retention, and defense; governmental and civil hearings; and legal challenges to governmental overreaching. We also assist with Medicare-Medicaid reimbursement and compliance, anti-kickback issues, and medical necessity and fraud and abuse matters. 
• Antitrust - includes advising clients on the legal ramifications of forming and merging provider groups, as well as the effects of health care contracting and terminations. We also assist clients regarding alleged restraints and exclusionary practices.
• Corporate and Business Transactions - represent health care industry clients in all aspects of operations and business transactions. We advise on corporate structure and formation; entity acquisition, divestiture, and reorganization; and intellectual property protection issues. Our attorneys also assist clients in establishing health care delivery systems, managed care organizations, and health care joint ventures, including arranging financing and facility and equipment leasing.
• Governance - assist our health care industry clients in a broad range of governance matters, including staff credentialing, peer review actions, and medical staff hearings. Also we will help with bylaws and policies and also have significant experience in advising clients regarding medical records disclosure.
• Insurance - employ our significant litigation experience to represent clients in national and regional pharmaceutical defense and liability litigation.

• Professional Licensure Issues - working with doctors, nurses, administrators, social workers, psychologists, and counselors and therapists and the appropriate state agencies to ensure professional licensure and renewal. Our attorneys also assist clients in medical facility and board informal and formal resolution processes.
• Quality Assurance and Liability Issues - assist clients in quality assurance and liability issues regarding patient care and risk management. We also have significant experience in advising on professional and corporate liability, corporate compliance, and peer review.
